BOOKING TERMS AND CONDITIONS

INTRODUCTION

  • The following booking conditions form the basis of your contract with Hermanus Camino.

    • A partnership operating as an outdoor adventure and tour facilitator in South Africa.

  • By confirming your booking:

    • You acknowledge that you have read and agreed to these conditions.

    • These conditions apply only to the tour arrangements booked through us.

  • References:

    • “Tour”, “booking”, “contract” or “arrangements” refer to arrangements agreed with us.

    • “Departure” refers to the start date of the tour arrangements.
       

COVID-19 NOTICE

  • You agree that travel is your personal decision.

    • You are responsible for informing yourself of travel risks and regulations.

  • We are not liable for:

    • Unsafe conditions, pandemics, illnesses, or health hazards.

    • Any loss, injury, delay, death, or financial cost related to COVID-19.

  • We will:

    • Endeavour to provide up-to-date travel information regarding COVID-19.

  • Insurance:

    • Most policies exclude pandemics—please consult a broker for advice.

    • We are not liable for:

      • Your decision not to purchase insurance.

      • Any rejected claims related to COVID-19.
         

BOOKING YOUR TOUR

  • Provisional bookings are confirmed only upon written confirmation from us.

  • If you are under 18, your parent/guardian must sign the application form.
     

PRICES AND PAYMENT

  • All tour prices include VAT.

  • Payment Terms:

    • EFT payments only.

    • 50% deposit due within 7 days of booking.

    • Booking will be cancelled if deposit is not received.

    • Balance due 30 days before arrival.

  • Banking Details:

    • Currency: South African Rand (ZAR)

  • If payment is not received on time, we reserve the right to cancel your booking and charge cancellation fees.
     

CHANGES AND CANCELLATIONS

  • Changes:

    • May be considered based on availability and practicalities.

    • Additional costs may apply.

  • Cancellations:

    • Must be sent by email and are effective upon written confirmation from us.

    • Cancellation fees:

      • 31+ days before departure: 0% cancellation fee (100% refund)

      • 30 days or fewer: 100% cancellation fee (0% refund)
         

THIRD PARTY SERVICE PROVIDERS

  • Your tour may include third-party services.

  • We are not liable for:

    • Loss, damage, injury, illness, or death due to third-party actions or omissions.
       

TRAVEL / MEDICAL INSURANCE

  • We recommend obtaining comprehensive travel insurance.

    • Ensure coverage for all tour-related activities.

    • Bring policy details on tour.

    • You are responsible for verifying the adequacy of your insurance.
       

INDEMNITY
Our Liability To You

  • We will ensure:

    • Tour arrangements are carried out with reasonable skill and care.

    • Operators are licensed, insured, and follow COVID-19 protocols.

  • We are not liable for:

    • Your acts or omissions.

    • Third-party acts not connected to the tour.

    • Force majeure events.

Your Liability To Us

  • You must disclose:

    • Any medical conditions or disabilities before booking or departure.

  • You are responsible for your and your party’s behaviour.

    • We reserve the right to remove individuals for:

      • Drunkenness, drug use, unlawful possession, disruptive behaviour, or risk to others.

    • No refunds or compensation will be given in such cases.
       

JURISDICTION

  • South African law applies to your contract.

  • All claims must be resolved by South African courts.
     

PRIVACY POLICY

  • We collect and process your personal data to:

    • Arrange tours and send marketing materials (with your consent).

  • Your data is protected under POPIA (Protection of Personal Information Act).

  • You have the right to:

    • Request access to, correct, or delete your data.

    • Withdraw consent for marketing at any time.

FORCE MAJEURE

  • “Force majeure” refers to unforeseeable events beyond our control.

    • Examples: war, terrorism, pandemics, natural disasters, strikes.

  • We are not liable for performance failures or damages resulting from such events.

  • Your nominated address on the signed contract will be used for communication.
     

GENERAL

  • This document (including annexures) is the entire agreement between you and us.

  • Any changes must be in writing and signed by both parties.

  • Failure to enforce provisions does not constitute a waiver.

  • If any clause is deemed unenforceable, the remainder of the contract remains valid.

The contract may be signed in counterparts, each considered an original.
